Welcome to LemonMade Memories. The terms “we,” “us,” and “our” refer to LemonMade Memories. LemonMade Memories operates this store and website, including all related information, content, features, tools, products, and services (the “Services”).
Our store is hosted on Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
1 — Access and Account

To purchase products, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent that the information you provide is accurate, current, and complete.
If you create an account, you are responsible for maintaining the security of your account credentials and for activity occurring through your account.
2 — Our Products and Personalized Items
We make every effort to provide accurate product descriptions, images, and examples. However, colors and product appearance may vary depending on screen or device settings, photo quality, printing, materials, and other factors.
Many LemonMade Memories products are personalized using content you provide, which may include photos, images, videos, audio or voice recordings, messages, names, dates, text, or other personalized content.
By providing content to us for an order, you represent that:

you own the content or have permission to use it for the requested product;

you have permission to provide content depicting or created by other individuals when required; and

your use of the content does not violate applicable laws or the rights of another person.
You grant LemonMade Memories permission to use the content you provide as reasonably necessary to create, process, fulfill, support, and, when necessary, troubleshoot your personalized order.
Because personalized products are made using customer-provided content, final results depend in part on the quality and composition of that content. Minor variations in color, cropping, alignment, sizing, print appearance, or similar characteristics do not necessarily indicate a defect.
If we notice an issue with customer-provided content that may significantly affect the finished product, we'll do our best to contact you before production begins.
We reserve the right to decline content or orders that we reasonably believe violate applicable law, infringe the rights of others, or cannot reasonably be produced.
We may modify product descriptions, discontinue products, or limit quantities at our discretion.
3 — Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline an order, including in cases involving payment issues, suspected fraud, unavailable products, production limitations, or content that cannot reasonably be produced.
Please review your order and personalized content carefully before submitting it.
Order Changes and Cancellations
Personalized orders may enter production quickly.
If you need to cancel or change an order, contact us as soon as possible at orders@LemonMadeMemories.com. We'll do our best to help before production begins.
Because each keepsake is made specifically for you, orders cannot be canceled once production has started.
Returns, refunds, replacements, and remakes are handled according to our Return & Refund Policy, including our 14-day window for reporting damaged, defective, or incorrect orders.
4 — Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged for an order is the price shown at checkout when the order is placed, subject to applicable taxes, shipping charges, discounts, and promotions.
You agree to provide current, complete, and accurate purchase and payment information.
Payment processing is handled securely by Shopify and/or applicable payment providers.
5 — Shipping and Delivery
Shipping and delivery times are estimates and are not guaranteed.
Delays may occur due to shipping carriers, weather, holidays, incorrect or incomplete addresses, or other circumstances outside our reasonable control.

6 — Intellectual Property
The LemonMade Memories name, branding, logos, website designs, text, graphics, product designs, original videos, and other content created by or for LemonMade Memories are protected by applicable intellectual property laws.
Unless otherwise permitted, you may not reproduce, distribute, modify, sell, or commercially exploit our content without our prior permission.
Customer-provided photos, videos, audio recordings, messages, and other personalized content remain the property of their respective owners. Providing this content to us does not transfer ownership to LemonMade Memories except for the limited permission necessary to provide the Services described in these Terms.
7 — Optional Tools and Third-Party Services
We may use or provide access to third-party tools and services to operate our business and provide our Services, including Shopify, payment processors, shipping providers, analytics services, communication services, and other integrations.
Third-party services may be governed by their own terms and privacy policies.
8 — Third-Party Links
Our Services may contain links to third-party websites or services. We are not responsible for the content, availability, policies, or practices of third-party websites.
9 — Relationship With Shopify
Our store is powered by Shopify, which provides technology that enables us to operate our online store.
Purchases from LemonMade Memories are transactions between you and LemonMade Memories. Shopify provides the ecommerce platform and related services but is not the seller of LemonMade Memories products.

Our collection, use, and sharing of personal information is described in our Privacy Policy.
Shopify and other service providers may also process certain information in connection with providing their services.
11 — Feedback and Reviews
If you voluntarily submit a product review, testimonial, feedback, suggestion, or similar content, you grant LemonMade Memories permission to use that content to operate, improve, and promote our products and Services, subject to applicable law.
You represent that you have the right to submit the content you provide.

To the extent permitted by applicable law, you agree to indemnify and hold harmless LemonMade Memories from claims arising from your violation of these Terms, violation of applicable law, or infringement of third-party rights resulting from content you provide to us.

These Terms are governed by the laws of the State of Iowa and applicable United States federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.
